FinanceGuard Acceptable Use Policy
Version 1.0.0 Effective Date: 19 April 2026 Operator: Plintar Systems Ltd. (trading as "FinanceGuard")
This Acceptable Use Policy ("AUP") sets out what you may and may not do while using FinanceGuard. It is incorporated into and forms part of our Terms of Service, and capitalised terms used here have the meanings given there.
Breaching this AUP is a breach of the Terms of Service and may result in suspension or permanent termination of your Account, deletion of Content, refusal to process pending payments, reporting to law enforcement, and claims for damages.
Legal review status. This AUP has been drafted by the FinanceGuard team and has not yet been reviewed by Nigerian-qualified legal counsel. It reflects what we will and will not tolerate on the Service today.
1. Who this AUP applies to
This AUP applies to every user of the Service, including Free Tier users, Paid Plan subscribers, invited collaborators, trial accounts, and anyone who submits content to us in any form (including support requests and bug reports).
2. You must comply with the law
You must not use the Service to do anything that is unlawful under any Applicable Law. This includes, without limitation, offences under:
- The Cybercrimes (Prohibition, Prevention, Etc.) Act 2015 (as amended).
- The Money Laundering (Prevention and Prohibition) Act 2022 and the regulations made under it.
- The Nigeria Data Protection Act 2023.
- The Federal Competition and Consumer Protection Act 2019.
- The Advance Fee Fraud and Other Fraud Related Offences Act 2006.
- The Terrorism (Prevention and Prohibition) Act 2022.
- Any tax law, including the Nigeria Tax Act 2025 and the Nigeria Tax Administration Act 2026.
- Any sanctions imposed by the United Nations, the United States (OFAC), the European Union, the United Kingdom, or the Federal Republic of Nigeria.
3. Prohibited activities
You must not, and must not attempt to, do any of the following when using the Service:
3.1 Misuse of the tax engine
- Submit data you know to be false or forged for the purpose of producing a misleading tax estimate, invoice, or report.
- Use FinanceGuard reports to claim compliance you have not achieved. Our reports are estimates and planning tools; they are not filings, assessments, or attestations.
- Back-date, alter, or fabricate transactions in a way designed to reduce your apparent tax liability below your actual liability.
- Claim expenses that are not allowable under Nigerian tax law when you know or should reasonably know they are not.
- Impersonate a chartered accountant, tax practitioner, or legal adviser in any export, report, share-link, or communication generated by the Service.
3.2 Misuse of other people's data
- Upload a bank statement, payslip, receipt, or other document that does not belong to you and that you do not have lawful authority to process.
- Upload data about another person (including a spouse, employee, employer, client, or counterparty) without their informed consent where consent is the lawful basis for the processing.
- Use the Service to profile, surveil, or investigate another person without lawful authority to do so.
3.3 Security and abuse
- Probe, scan, reverse-engineer, or penetration-test the Service, except under a written bug-bounty or responsible-disclosure agreement we have signed with you.
- Attempt to bypass authentication, authorisation, rate-limiting, billing, quota, or any other security or entitlement control.
- Use automated tools (bots, scrapers, crawlers) to access the Service beyond the rate and scope documented in our public API docs.
- Upload, generate, or transmit malware, ransomware, spyware, worms, logic bombs, cryptocurrency miners, or any other malicious or autonomous code.
- Intercept, divert, tamper with, or interfere with the traffic or data of any other user.
- Deny or disrupt service to other users (DoS, DDoS, flooding, amplification).
- Harvest or enumerate user identifiers or other personal data.
3.4 Abuse of other users and our people
- Send abusive, harassing, threatening, discriminatory, or sexually harassing messages to other users, our support team, or our consultants.
- Incite, facilitate, or engage in violence, self-harm, or harm to others.
- Use the Service to stalk, dox, blackmail, or coerce any person.
3.5 Financial crime
- Use the Service to plan, execute, conceal, or launder the proceeds of any offence.
- Use the Service to evade sanctions or facilitate transactions with sanctioned persons.
- Create accounts using another person's identity or using synthetic or stolen identity documents.
- Operate multiple accounts to evade rate limits, plan limits, trial restrictions, or a prior suspension or termination.
3.6 Intellectual property and content
- Upload or transmit content you do not have the right to share, including content that infringes copyright, trade mark, trade secret, or confidentiality obligations.
- Remove, hide, or alter any copyright, trade mark, attribution, or watermark on the Service or on content you export from it.
- Use the Service to create, host, or distribute content that is defamatory, obscene, exploitative of minors, or otherwise unlawful.
3.7 Interference with the Service itself
- Copy, mirror, frame, sublicense, or resell the Service, or create a derivative product that depends on unauthorised access to our APIs, data, or models.
- Use the Service, our brand, our data, or our outputs to train a competing machine-learning model or to benchmark a competing product without our prior written consent.
- Remove or alter our branding in screenshots, reports, or embeds in a way that misattributes the output.
4. Use of AI features
Where the Service offers AI-assisted features (such as receipt OCR, transaction categorisation, or insights), you agree that:
- Output is not guaranteed to be correct. You must review and correct AI output before relying on it for filings, payments, or any legal or financial decision.
- You are responsible for what you export or share. If you publish, send, or file an AI-generated output, you accept its content as your own statement.
- You will not knowingly feed AI features falsified data in an attempt to produce misleading outputs.
5. Use by businesses and employees
If you use FinanceGuard on behalf of a company, partnership, or sole proprietorship:
- You confirm you have authority to bind that entity.
- You are responsible for its users' compliance with this AUP.
- You must not upload employee payroll data, customer transaction data, or other third-party personal data unless you have a lawful basis under NDPA and a written data-processing arrangement with us where one is required.
6. Our enforcement rights
We may, at our sole discretion and without prior notice where reasonable:
- investigate suspected breaches;
- preserve, inspect, or disclose content and account metadata to the extent necessary to investigate or resolve a breach;
- throttle, suspend, or lock features, accounts, exports, or payouts;
- terminate the Account and delete Content in line with our retention policy;
- refuse refunds where a suspension or termination is attributable to a breach of this AUP;
- report suspected criminal conduct to the relevant authorities and cooperate with their investigations under lawful process.
Where we act without prior notice, we will (where lawful and safe to do so) notify you within a reasonable time and give you an opportunity to respond.
7. Reporting abuse
If you believe another user is breaching this AUP, email abuse@financeguard.ng or, until that mailbox is provisioned, hello@financeguard.ng with subject line "AUP report".
If you have found a security vulnerability, please report it privately to security@financeguard.ng (or hello@financeguard.ng until that mailbox is provisioned) rather than using the abuse channel.
8. Changes to this AUP
We will update this AUP when new patterns of abuse emerge, new features ship, or the law changes. Minor changes update the last_updated date; material changes update the version and effective date and will be notified in-product.
